Consignments:

Fees:
1. Our commission is 30% of the selling price.
2. No fee for consigning your items with us.

Pricing:
1. Determine a fair market price for your item. In the event you, the consignor, are selling like items online, mail order or from a brick and mortar establishment, Lillian Jaffe.com must sell the goods for the same price that you are selling the item to the public.
2. Include the cost of packaging your item and the shipping insurance within the price of the item.
3. Insurance is calculated on the value of the object. We typically ship via USPS Priority Mail. For example: insuance is $1.30 for an item under $50.00 and $2.30 for an item between $50. - $100.00, etc.. We will help you with this if you have any questions. Insurance and shipping costs change periodically and must allow for adjustments.
4. Other dealers often buy from us. When determining your price, please consider a 20% discount to the trade.

Payment:
1. Consignors are paid within 30 days after their sell.
2. Consignors are responsible for credit card fees incurred for each item sold.
3. Consignor will be paid via PayPal cash transfer.
4. Consignor will be paid the selling price minus 30%, the credit card fees and the shipping charges (in the event the rate has changed and the selling price has not been adjusted to include the change) for each item sold.
5. All payment must be in US dollars.

Returns:
1. In the event the customer returns an item found to be misrepresentend by the consignor of the item, the customer will receive a full refund. However; the consignor will be charged 30% of the selling price, S&H, credit card fees and other related expences. Upon receipt of payment, item will be returned to the consignor.
2. In the event an item is returned to the consignor by Lillian Jaffe.com due to the item being misrepresentated by the consignor of the item, the consignor will pay Lillian Jaffe.com 30% of the selling price plus credit card fees.
3. In the event the item is returned due to damage in shipping, fees not reimbursed by the carrier will be charged back to the consignor.

Item Descriptions:
You (the consignor) provide Lillian Jaffe.com with an accurate description and digital photos of the item.
1. Use concrete language to write the item description in as few words as possible.
2. Description should include the weight in pounds and ounces plus:

3. Describe the color, material, features or characteristics.
4. Provide credible substantiation of any claim you make regarding the material, origin and age of the item.
5. We offer our customers the finest contemporary, vintage and antique items. Items must be clean with no need of repairs. Do not ship items to us without prior approval.
6. We must be in physical possession of consignment items in order to effectively market them and avoid misrepresentation. Consignor pays for all shipping and insurance to Lillian Jaffe.com and from Lillian Jaffe.com to the consignor in the event the item is returned.

Images:
1. All digital images and photographs must be in focus and represent the color of the object accurately.
2. Photograph the object from every angle and position in natural day light.
3. Include full image of front, back, sides, top and bottom where applicable.
4. Include close-up detail shots of designer or manufacturer's marks and signatures, repairs, scratches, chips, abrasions, dents, wear marks or damages.
5. Do not e-mail your images.
6. Save digital images in .jpg, .tif or .psd format onto CD-ROM, zip disk or floppy disk and mailed to Lillian Jaffe.com via first class mail. Do not compress or zip images.
7. If you are adept at digital image editing, e-mail image files. All files must be under 25K
8. If your images are on a remote server, e-mail us with the links to the images and we will download the images.
9. If unable to provide digital images, take clear in-focus photographs of the object as described above. We will convert your photographs into digital images. You may need to re-shoot the object if your photographs are not of sufficient quality to render digitally. If you are new at this, no need to worry, it takes practice and we will offer advice.
10. Please allow one week for a response. Mail the package to:

11. Consignors may submit images relevant to the product so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation.
12. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of content.
13. Lillian Jaffe.com reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.
14. If you do post content or submit material, and unless we indicate otherwise, you grant Lillian Jaffe.com and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
15. You grant Lillian Jaffe.com and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Lillian Jaffe.com or its affiliates for all claims resulting from content you supply.
16. Lillian Jaffe.com has the right but not the obligation to monitor and edit or remove any activity or content.
17. Lillian Jaffe.com takes no responsibility and assumes no liability for any content submitted to the site that is questionable: illegal, obscene, threatening, defamatory, invades ones privacy, infringes on intellectual property rights, or otherwise is injurious to third parties.

Other Terms and Conditions
1. Consignment terms are subject to change at the discretion of Lillian Jaffe.com. 2. Consignors will be notified of changes online at Lillian Jaffe.com via this document.
3. Consignment may be canceled by the consignor or Lillian Jaffe.com at any time upon the completion of any and all product sales that may be in progress..
4. Lillian Jaffe.com reserves the right to return any item to the consignor if the item does not match the description and images provided by the consignor to Lillian Jaffe.com.
5. Consignment agreement reached between Lillian Jaffe.com and the consignor are concurrently governed by the stipulations in the Lillian Jaffe.com Conditions of Use Statement, Policy Notice and Shipping & Returns Statement as relevant to consigning objects for sale to Lillian Jaffe.com.

Copyright:
1. Lillian Jaffe.com and its affiliates respect the intellectual property of others.
2. Lillian Jaffe.com reserves the right to edit the written decriptions and images that you provide for your objects.
3. The product descriptions and images you provide will be used for the express purpose of promoting and selling your items.
4. If you believe that your work has been copied in a way that constitutes copyright infringement, email us with your complaint.

Risk of Loss:
1. All items consigned to lillianjaffe.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to the customer upon the delivery to the carrier.

Product Descriptions:
1. Lillian Jaffe.com and its affiliates attempt to be as accurate as possible.
2. Lillian Jaffe.com does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.
3. If a product offered by Lillian Jaffe.com itself is not as described, Lillian Jaffe.com will return the object to the consignor at the consignor's expense.

Other Business:
1. Parties other than Lillian Jaffe.com and its subsidiaries do not operate stores, provide services, or sell product lines on the Syd Harrice Web site.
2. By accepting the consignor's objects for sale, Lillian Jaffe.com does not warrant the offerings of any of these businesses or individuals or the content of their Web sites.
3. Lillian Jaffe.com does not assume any responsibility or liability for the actions, product, and content of any third parties. You should carefully review their privacy statements and other conditions of use.

Disclaimer of Warranties and Limitation of Liability:

Disputes:

Any dispute relating in any way between the consignor and Lillian Jaffe.com or to products consigned through Lillian Jaffe.com shall be submitted to confidential arbitration in Allentown, Pennsylvania, except that, to the extent you have in any manner violated or threatened to violate Lillian Jaffe.com intellectual property rights, Lillian Jaffe.com may seek injunctive or other appropriate relief in any state or federal court in the state of Pennsylvania, and you consent to exclusive jurisdiction and venue in such courts.
2. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association.
3. The award of the arbitrator shall be binding and may be entered as a judgment in any court of competent jurisdiction.
4. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
